1. General notice
Mikis is an AI-assisted software solution for the intelligent processing, retrieval, structuring, analysis and presentation of information. Depending on its design, Mikis can run locally, in a private cloud or with connections to external systems. The platform is designed to work with organisation-specific data, documents and knowledge.
Content, answers, analyses, summaries, recommendations, classifications, translations and other outputs provided by Mikis are generated wholly or partly through automated processes using artificial intelligence.
2. No substitute for human review
Content generated by Mikis serves solely to support work, research, documentation, communication and decision-making processes.
Mikis does not replace human professional, legal, technical, organisational or other review of individual cases.
In particular, Mikis outputs do not replace individual legal, tax or business advice, medical assessment, security reviews or other professional assessments of individual cases.
3. Potential for incorrect results
Despite careful configuration, data preparation and ongoing optimisation, Mikis and the integrated AI models may produce incorrect, incomplete, ambiguous, outdated, biased or factually inaccurate results.
This applies in particular to:
- ambiguous or incomplete inputs,
- unclear data,
- conflicting sources,
- unsuitable or incomplete document collections,
- changes to models, interfaces or third-party systems,
- open-ended questions or complex assessments of individual cases.
4. User's duty to review
Users are responsible for reviewing all content, answers, recommended actions, evaluations, summaries, classifications, translations and other results provided by Mikis before using them.
This applies in particular before:
- publishing or sharing content,
- use in dealings with customers, authorities, courts or other third parties,
- use in decisions with legal, financial, technical or organisational implications,
- use in sensitive areas such as human resources, health, law, administration, compliance, funding, security or finance.
Responsibility for the actual use, approval, interpretation and implementation of content rests exclusively with the relevant user or deploying organisation.
5. No guarantee of accuracy or suitability
No guarantee is given as to the factual accuracy, completeness, currency, consistency or fitness for a particular purpose of content generated by Mikis.
In particular, no guarantee is given that:
- outputs will always be free of errors,
- answers will be complete or legally reliable,
- results will be suitable for a specific use case,
- all relevant information will be identified or considered,
- external or internal data sources will always be complete, correct or up to date.
6. No liability for use without review
To the extent permitted by law, liability is excluded for damage, loss or consequential damage arising from users adopting, publishing, sharing or making decisions based on Mikis content or results without reviewing them.
This applies in particular to damage arising from:
- incorrect or incomplete answers,
- hallucinations or incorrect conclusions,
- ambiguous wording,
- incorrect summaries or classifications,
- translation errors,
- incorrect source references,
- failure to obtain human review or approval.
Mandatory statutory liability provisions remain unaffected.
7. Data sources and third-party providers
Depending on its configuration, Mikis can connect to internal documents, knowledge bases, interfaces, external services or language models. Result quality depends significantly on the quality, currency, structure and suitability of the data sources, as well as the models and system settings used. The Mikis website expressly describes this architecture as an on-premises/private cloud solution connecting different models and data sources.
Where external systems, APIs, models or third-party services are integrated, their availability, behaviour, answer quality, pricing or terms of use may vary. These factors are outside our control.
Depending on its configuration, Mikis can connect to locally hosted or cloud-based language models and AI services. Where these models or services are supplied by third parties, Expert Solutions Strahlhofer has no control over their availability, behaviour, changes or terms of use. To the extent permitted by law and subject to any individual agreement to the contrary, no warranty is given for such third-party services and liability is excluded in this respect. Services expressly promised by Expert Solutions Strahlhofer itself remain unaffected.
8. Responsible use of AI
Using AI requires organisational, professional and legal care. Users and deploying organisations must ensure that Mikis is used only within the applicable legal and appropriate operational framework.
Where statutory information, transparency, review, documentation or training obligations apply, the relevant operator or user is responsible for meeting them. The Mikis website itself highlights AI Act requirements such as transparency, risk analysis and AI literacy.
9. Availability and technical changes
There is no entitlement to uninterrupted, unchanged or error-free availability of Mikis or any of its functions, interfaces, modules, models or integrations at all times.
We reserve the right to make technical developments, adjustments, model changes and changes to retrieval mechanisms, user interfaces, system components or security measures, provided these do not unreasonably impair the essential intended use.
10. Data protection and data sovereignty
Mikis is designed for data sovereignty. Depending on the deployment model, data can be processed locally, in a private cloud or through controlled connections to external systems. The website expressly highlights this privacy-focused architecture.
Before any production deployment, the data protection, organisational and technical requirements applicable to the specific use case must be assessed independently of the above.
The website privacy notice also applies.
11. Precedence of individual agreements
Where separate contracts, proposals, service descriptions or general terms and conditions have been agreed for individual services, projects, implementations, training, trials, hosting or support, those provisions take precedence over this usage notice within their respective scope.
