What legal obligations apply when using AI?
The EU AI Act requires companies, organizations, and public institutions to use artificial intelligence in a lawful, transparent, and responsible manner. Key requirements include:
- Mandatory AI literacy in accordance with Article 4 EU AI Act
- Risk-based assessment of AI systems
- Compliance with the GDPR and data protection regulations
These obligations apply regardless of industry or company size and form part of an organization’s general duty of care. In the event of damage or liability claims, missing or undocumented AI training may be considered a breach of duty.

Legal Framework
Article 4 EU AI Act obliges providers and deployers of AI systems to take appropriate measures to ensure that all persons involved in the operation or use of AI possess sufficient AI competence.
Article 3(56) EU AI Act defines AI literacy as the skills, knowledge, and understanding required to use AI systems competently and to recognize opportunities, risks, and potential harm.
While the EU AI Act does not mandate a specific training format, it explicitly requires a role-based, risk-oriented, and documentable implementation.
